Cell Phone Ticket

A ticket for using a cell phone or electronic device is worth fighting since pleading guilty will result in points on your license. There are two different statutes associated with a cell phone tickets: VTL 1225(c) and VTL 1225(d).
If you received a 1225(c) ticket, the officer is accusing you of actually making a phone call while driving.
For 1225(d) tickets, it is irrelevant whether you were actually on a call. If you were texting or using an app, you can be given a 1225(d) ticket. You can receive a ticket for VTL 1225(d) for using other electronic devices including an MP3 player or GPS.
